K. DETAINED ON DUTY FROM NIGHTSHIFT

It is a common occurrence that officers are detained on duty from nightshift into the following force day.  Different levels of compensation are available dependent on the ‘status’ of that next day as follows:

  • A working day (payment or TOIL at time and a third for each completed period of 15 minutes worked) (see section 2.41)
  • A rest day not within a period of annual leave (payment or TOIL at double time for each completed period of 15 minutes worked) (see section 2.5)
  • A public holiday (if rostered to work on that public holiday, payment or TOIL for a minimum of 4 hours at double time: if not rostered to work on that public holiday, payment or TOIL for a minimum of 4 hours at double time and another public holiday) (see section 2.6)
  • An annual leave or rest day which forms part of a period of annual leave as defined at 2.7(a) (one annual leave/rest day and one day’s pay at double time, or two annual leave/rest days) (see section 2.7)
  • An annual leave day which does not form part of a period of annual leave (one day’s annual leave) (see section 2.7)
